Every Portuguese citizen who has their divorce sentence decreed by a Court outside of Portugal, must, compulsorily, register it in the Portuguese Civil Registry, as established in the Civil Registry Law.
If your divorce decision was made in a member state of the European Union, it may be recognised in the other member states directly at the civil registry offices, fulfilling only certain specific documentary requirements.
However, if the decision was made in a third country (outside the European Union), you must submit it to a Portuguese Court to be reviewed and confirmed. This is a judicial process that goes through a Judicial Court in Portugal (Tribunal da Relacão), and aims to give the recognition of the decision in Portuguese legal terms.
Tobo & Quintana law firm is able to perform both the transcription of the divorce in the Civil Registry, as well as bring an action to recognize the divorce decision, without having the need of the client to travel to Portugal.
